A person who accepts the role of a PR, executor, or personal representative in a Florida Probate Administration has a duty to act for the benefit of the beneficiaries of the decedent estate. If the Florida PR fails to properly administer the decedent's estate, the PR they can be liable to the other beneficiary for their mistakes. Sometimes beneficiaries seek to remove the Personal Representative because of an act or the failure to act that causes a waste or mismanagement of the decedent's assets. Another remedy that the beneficiaries of a Florida Trust can seek is called a surcharge action. In Florida the purpose of a surcharge action is to restore the losses because of the Breach of Duty of the Personal Representative.
